1. Acceptance of Terms

By accessing or using the ETH-SMART platform, interacting with our smart contracts, or creating an account, you agree to be bound by these Terms of Service and our Privacy Policy.

2. Platform Description

ETH-SMART is a decentralized application (dApp) built on the Ethereum blockchain that provides:

• Smart contract-based staking and node rewards
• Multi-level referral commission system
• Real-time cryptocurrency market data integration
• Decentralized finance (DeFi) yield generation

3. Smart Contract Risks

IMPORTANT: By using our platform, you acknowledge and accept:

• Smart contracts are immutable once deployed on Ethereum
• Gas fees (transaction costs) are non-refundable
• Potential vulnerabilities despite security audits (reentrancy, front-running, etc.)
• Loss of funds due to wallet compromise or private key exposure
• Regulatory uncertainty in your jurisdiction

4. User Responsibilities

As a user, you agree to:

• Maintain security of your wallet private keys and seed phrases
• Not engage in fraudulent or manipulative activities
• Comply with all applicable laws in your jurisdiction
• Not attempt to exploit smart contract vulnerabilities (responsibly disclose via bug bounty)
• Verify transaction details before signing

5. Fees and Rewards

Our smart contracts collect fees for platform operations:

• Node activation: 0% platform fee (only Ethereum gas fees apply)
• Reward distribution: 5% fee for protocol maintenance
• Withdrawal fees: Variable based on network congestion (gas)
• Referral commissions: Distributed automatically via smart contract

All fees are transparent and verifiable on the blockchain.

6. Prohibited Activities

The following activities are strictly prohibited:

• Money laundering or terrorist financing
• Sanctions evasion (OFAC, EU, UN lists)
• Creating multiple accounts for bonus abuse (Sybil attack)
• Automated bots for unfair advantage (without permission)
• Manipulating referral systems or fake registrations

7. KYC and AML Compliance

We reserve the right to request KYC verification for:

• Large withdrawals exceeding $10,000 equivalent
• Suspicious transaction patterns
• Legal or regulatory requirements

Failure to provide requested information may result in account suspension.

8. Termination and Suspension

We may terminate or suspend access to our platform immediately, without prior notice, for:

• Violation of these Terms
• Engaging in prohibited activities
• Legal requirements from regulatory authorities
• Security vulnerabilities or attacks on the protocol

Termination does not affect previously recorded blockchain transactions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ETH-SMART is provided "AS IS" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Total liability shall not exceed the amount paid by you to our platform
• We are not responsible for Ethereum network failures, congestion, or forks

10. Governing Law

These Terms shall be governed by the laws of Switzerland, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Geneva.
